Donald Trump has stated that he plans to declare a national emergency as a response to a so-called “invasion” of illegal immigration. This would pave the way for the use of the National Guard to the Southern border, as he did during his first term. Presidents have done this before, though with certain restrictions, limiting their involvement to roles such as logistical support, data entry, surveillance and warehouse support. The incoming administration intends to use the military in such a support role for deportation, according to Tom Homan, Trump’s so-called border czar.
Federal law generally prohibits the use of active-duty service members for law enforcement within the United States unless explicitly authorized by Congress. There are legal restrictions against using the U.S. military against civilians, to which he stated that the people who would be targeted would not be civilians. The Oxford dictionary defines a civilian as “a person not in the armed services or the police force,” which is unavoidably true of undocumented immigrants who could not obtain membership in either of these groups without legal residence.
It is important to note that despite his efforts during his first term, Trump was unable to deport more people than former President Obama. Should Trump follow through with this mass deportation effort, experts have calculated the cost to the nation to be nearly a trillion dollars over the course of a decade.
