USCIS Releases New Guidance on E-11 Visa Eligibility Criteria

U.S. Citizenship and Immigration Services (USCIS) has issued policy guidance in our Policy Manual to further clarify the types of evidence they can evaluate to determine eligibility for EB-1 immigrant visa classifications for professionals with extraordinary ability (E11).

Policy Guides:

  • Confirm that they consider the receipt of team awards by an individual under the criteria of awards or recognitions of lesser national or international recognition for excellence in the field of activity;
  • It clarifies that they consider previous memberships under the membership criteria;
  • Removes language suggesting that published materials must demonstrate the value of the individual’s work and contributions to meet the criteria for published materials; and
  • He explains that while the dictionary defines an “exhibition” as a public exhibition not limited to art, the regulation expressly modifies that term with “artistic,” so that they only consider non-artistic exhibitions as part of a duly submitted request for comparable evidence.

This new guidance builds on an earlier update to the EB-1 policy and provides more clarity and transparency to help petitioners present adequate evidence that can demonstrate beneficiary eligibility.

This policy update will take effect once it is published and governs and supersedes any previous guidance on the topic. For additional information, see USCIS Volume 6, Part F, Chapter 2 of the Policy Manual.
