USCIS Reaches Regulatory Maximum Number of H-2B Visas

USCIS: “We have received sufficient petitions to reach the statutory maximum number set by Congress for H-2B visas for temporary nonagricultural workers for the first half of fiscal year 2025. September 18 was the final receipt date for new petitions subject to the statutory maximum number of H-2B visas requesting an employment start date before April 1, 2025. We will reject new H-2B petitions subject to the statutory maximum number that are received after September 18 that request an employment start date before April 1, 2025.”

“We continue to accept H-2B petitions for workers who are exempt from the statutory maximum amount set by Congress.
This includes petitions for:

  • Current H-2B workers in the United States who request to extend their stay, change employers or change the terms and conditions of their employment;
  • Processors, technicians and/or supervisors of fish roe processing; and
  • Workers performing work or services in the Commonwealth of the Northern Mariana Islands and/or Guam from November 28, 2009 through December 31, 2029.”

“U.S. businesses use the H-2B program to employ foreign workers for temporary non-agricultural employment.
Currently, Congress has set the statutory maximum number of H-2B visas at 66,000 visas per fiscal year, with 33,000 for workers who begin employment in the first half of the fiscal year (October 1 through March 31) and 33,000 visas (plus any unused numbers from the first half of the fiscal year) for workers who begin employment in the second half of the fiscal year (April 1 through September 30).”
