USCIS Makes Additional Updates to Policy Guidance on the "Apply to Obtain" Requirement Under the Child Status Protection Act
USCIS has updated guidance in Volume 7, Part A, Chapter 7 of the Policy Manual to clarify how they calculate age under the Child Status Protection Act (CSPA) for noncitizens who demonstrate that they are experiencing extraordinary circumstances.
The updated guides:
- Clarify that the age calculation under CSPA of an applicant who demonstrated extraordinary circumstances and is excused from the “sought to acquire” requirement uses the date the immigrant visa was initially available when the immigrant visa is continuously available for one year without any intervening period of unavailability; and
- Clarifies that, under circumstances where the immigrant visa was initially available and then unavailable, the age calculation under CSPA may use the date the immigrant visa was initially available if the applicant demonstrates extraordinary circumstances for not applying for adjustment of status before the immigrant visa became unavailable.
The previously published policy did not address the effect on the age calculation under CSPA for a noncitizen who experiences extraordinary circumstances for the purpose of excusing the existing “having applied for the purpose of obtaining” element within the initial visa availability period.
We updated this guidance to ensure efficient and consistent adjudication in these cases.
